Terms & Conditions
These terms and conditions are written in natural language, as opposed to the more common very formal legal texts. Basically we strive towards a high quality service, for which we expect to get paid (a fair amount of money within a reasonable time). Daigu is a part-time company; this affects the maximum hours per week we can work, and our response time (e.g. we cannot guarantee a fast response during normal office hours). As part of our CSR programme, we always encourage our clients to include NGO support in their projects. Should you find any fault with this text, kindly inform us at info@daigu.nl.
See Terms & Conditions (2010) for our old terms and conditions.
Offers
If we make you an offer, you are free to accept or decline. We will indicate whether VAT is included or not. Since we shouldn't overwhelm ourselves, we can only accept a certain number of assignments at once (depending on the amount of work involved, and how we can distribute this work internally). A "first come, first serve" approach seems fair. Any special offers do not automatically apply to future offers.
Contracts
We will always do our very best to provide our clients with a high quality service. For each project we should discuss a time table, and we will try to respect deadlines; however, since any project is unique, unexpected events might cause a delay. In any case, we will communicate our progress to our clients, just as we expect that our clients report to us. Though a project is supposed to be fixed from the start, changes are bound to occur. Small change requests (e.g. not involving too much extra time/work) will be taken along free of charge. In case of major revisions, we'll have to discuss how much extra time or money is needed, and whether it is possible at all. The contract will contain some details on milestones linked to payment.
Payment
Our invoices should be as clear as possible, with a description of the project, activities, time period, a total fee (in euros) and the VAT. This way our clients can reclaim their VAT from the tax office. Deadline for payments is thirty (30) days, but we accept delays if notified in advance. The average fee for our services is thirty-five (35) euros per hour, though this is only mentioned here as an indication.
Ownership
There's intellectual property and data ownership. Whenever the project or client does not explicitly define ownership, we'd like to select a Creative Commons license (http://creativecommons.org/license/), together with the client.
Guarantee
The only true guarantee we can offer is that by our knowledge, experience, and a quality assurance process we should be able to deliver a high quality service, without any mistakes. If something does go wrong (as Murphy says it will), then we will correct the issue.
Liability
We cannot be held responsible for any damage caused by our services, unless caused by negligence or sheer incompetence. We aim to resolve any miscommunication by sharing responsibility with the client. This is simply done by asking the client to accept a deliverable before going live.
